Your order confirmation shall state an estimated delivery date. Due to various factors which can effect delivery, this date is an estimate and can not be guaranteed unless it clearly states “Guaranteed Delivery by such date”.
Delivery fees are calculated based on the number of items and the weight of such items. The delivery fee shall be shown to you prior to your submission of the order. In the event you have additional expedited delivery options available, each option and its associated delivery fee shall be shown and you may choose an option and fee.
We cannot guarantee that a certain Supplier will be able to deliver to your address. In the event a Supplier cannot deliver to you, we will give you the option to change your delivery address or to cancel the order and refund any payment processed.
Delivery arrangements and costs are solely between you and the Supplier and you hereby agree to indemnify and keep indemnified NowShop against any loss or damage whatsoever arising out of or in connection with the delivery of any Order/s.
We will treat all your Personal Information as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable EU Data Protection and consumer legislation from time to time in place.
When you shop on the Service, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, billing address, delivery address, telephone number, product selections, credit card or other payment information and a password. We may also collect, and our third party providers of advertisements and content may collect, information about where you are on the internet (eg the URL you came from, IP address, domain types like .no and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, the advertisements you clicked on, and any search terms that you entered on our website ("User Information"). We may collect this information even if you do not register with us.
We confirm that any Personal Information which you provide to us (or which is available on public registers) and any User Information from which we can identify you, is held in accordance with the relevant EU Data Protection laws. We use your information only for the following purposes:

The National Magazine Company Limited is the legal name of Hearst Magazines UK. It owns and publishes a number of titles, including the Red Direct Magazine.
The site enables third party sellers selected by us to advertise and offer products for sale. Whilst we review sellers and the products they list from time to time we're not responsible for the existence, quality or accuracy of listings, and we don't have possession of the products.
We don't guarantee that the site (or its content) will always be available, free from errors or omission, or that access to it will be uninterrupted. We'll not be liable if for any reason the site (or any part of it or its content) is unavailable at any time or for any period. We and the sellers may update the site and its content at any time.
Access to the site is permitted on a temporary basis which means we can suspend, withdraw, discontinue or amend all or any part of it or its content without notice.
If you suspect or know that your security details may be known, or are being used, by a third party you must change them and let us know. We can suspend or disable security details if we know or suspect misuse or fraud or if, in our opinion, you've failed to comply with these terms.
We own, or are the licensee of, all intellectual property rights in and to the site and all the material and content published on it (this includes rights such as patents, copyright, trade secrets and trademarks). You must not extract or otherwise use the site (or the material or content published on it) for any commercial purposes without first obtaining a licence to do so.

PLACING AN ORDER
The site takes you through the steps you need to take to place an order. Seller and product pages may set out shipping exclusions, subsidies or additional charges. Please take care to check details and amend any errors before submitting your order. If a product has age restrictions, please don't order it unless you meet them.
Who do I contract with when I place an order?
From a legal point of view your order is deemed to be an offer by you to purchase the products, meaning the contract only becomes binding on you and the seller if the seller accepts your offer/order. Your contract will be with the seller (not us) and will be based on: (i) these terms; (ii) any additional terms on the seller's page or the product page; and (iii) the terms of your email confirmation.
Your order isn't deemed accepted by the seller until we (acting as their commercial agent) have sent you an email order confirmation. If there's a conflict or inconsistency between these terms and that email confirmation, or the seller's or product page, these terms prevail.
Remember that both the seller's and product pages will set out key information you need to be aware of before placing your order (so before entering intoyour contract) including information about: the characteristics of the product; the identity of the seller; the seller's address, place of business and contact information; any restrictions on delivery; and details of the price, delivery and payment. Please read this carefully before placing your order
We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We'll not be liable to you or any third party by reason of any such refusal, or by reason of unwinding or suspending a transaction after processing has begun.
Our site contains a large number of products. It's always possible that despite best efforts, some may be incorrectly priced. If an error in pricing is discovered we or the seller will contact you to let you know and give you the option of continuing to purchase the product at the correct price or cancelling your order. We'll not process your order until we've heard from you. If we're can't contact you using the details you provided we'll treat your order as cancelled and notify you in writing. Please note if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we don't have to provide the products to you at the incorrect price.
What if the product I've ordered isn't available?
If your seller can't provide a product (e.g. it's no longer in stock or available, or because of an error in the pricing) we'll inform you as soon as we're able to and your order won't be progressed. If you've already paid for the product, you'll be refunded as soon as possible. See our Returns Policy for more information.
Can I cancel an order?
As a consumer you have a legal right to cancel your contract during the following periods:

Note if you've ordered sealed products which aren't suitable for return (e.g. due to health protection or hygiene, or items like audio, video or computer software) you won't be able to cancel your contract if those products become unsealed after delivery. Please see our Returns Policy for more information on these and other products where returns cannot be accepted.
What happens if I cancel my contract?
If you cancel your contract, the seller will make any associated refunds in accordance with our Returns Policy. If you wish to cancel your order please contact the seller by using the details found on the order confirmation and dispatch emails to cancel your order. Please include details of your order so that they are able to find it.
How can I pay?
Purchases from sellers can only be paid for using a debit or credit card through our payment facility (or any other payment method we make available from time to time). In accepting or processing your payments for products from a seller, we act in the capacity as commercial agent of the seller.
Our sellers agree that valid payment by you to us for a product you've ordered from them will satisfy your obligation to pay them for that item (and that therefore any debt obligations owed by you to them for that item will be extinguished at that time).
Our sellers also agree that they'll not seek recourse (legal or otherwise) against you for payment for products if you've already validly paid us.
All prices shall be shown in the applicable currency and payable in that currency. You accept that some banks may charge you an additional fee for certain transactions (for example, international transactions). You accept that item prices in the currencies displayed may vary according to your location.

Your basket displays the products you've chosen, the relevant seller(s) who'll provide them and the details of delivery and applicable charges from each seller. Delivery costs vary from seller to seller (depending on the delivery methods they offer, and where you're based). Delivery times quoted are in working days.
For delivery destinations within the EU, prices include VAT or other sales taxes where applicable. For delivery destinations outside the EU, prices do not include VAT or other sales taxes.
If you order goods to be delivered outside the UK please remember that they may be subject to import duties and taxes levied when they reach the specified destination. We have no control over these charges and can't predict their amount. You'll be responsible for payment of any such charges, so we suggest you contact your local customs office before placing your order.
QUALITY OF PRODUCTS
Your contract is with the seller. As a consumer, your seller is under a legal duty to supply products that conform with these terms, their page, the relevant product page, and the terms of your email confirmation. You have legal rights in relation to any product supplied that is faulty or not as described. These rights are not affected by anything in these terms.
We're not a party to your contract and don't have possession of the products, so we don't give any undertaking that they'll be of satisfactory quality. This and any other warranties (express or implied) are disclaimed by us to the fullest extent permitted by law. This disclaimer doesn't affect your legal rights against the seller.
LIMITATION OF LIABILITY
Nothing in these terms or your contract excludes or limits our or a seller's liability for: (i) death or personal injury arising from our or their negligence; (ii) fraud or fraudulent misrepresentation; (iii) any other liability that can't be excluded or limited by English law.
Nothing in these terms or your contract excludes or limits a seller's liability for: (i) any breach of the terms implied by sections 12 - 15 of the Sale of Goods Act 1979; or (ii) defective products under the Consumer Protection Act 1987.
If we and/or a seller fail to comply with these terms or your contract we and/or that seller (as applicable) will only be responsible for loss or damage you suffer that is a foreseeable result of the breach or negligence ('foreseeable' means it was an obvious consequence or was contemplated by the parties to a contract at the time of entering into it).
The site is provided “as is” and “as available” and we expressly disclaim to the fullest extent permitted by law all express, implied and statutory warranties.
LINKS TO AND FROM OUR SITE
We're happy for you to link to the home page of our site provided you stick to these rules: (i) you link in a way that's fair and legal, and don't damage (or try to take advantage) of our reputation; (ii) your link doesn't suggest any form of association between our site and yours, or imply or suggest that we approve or endorse your site or its content; (iii) you don't create a link to our site in any website that you don't own; (iv) you don't frame our site on any other website; and (v) you don't link to any page other than our homepage. We reserve the right to withdraw this linking permission at any time without notice.

Waiver: if at any time we or a seller fail to insist that you perform any of your obligations under your contract, or if we or a seller don't enforce our rights or remedies against you (or delay doing so) it won't mean we've waived our rights against you and won't mean that you don't have to comply with your obligations. If we do waive your default, we'll only do so in writing and it won't mean that we automatically waive any further or later default by you.
Severance: each part of these terms and your contract operates separately. If a court or competent authority decides that any part is invalid, unlawful or unenforceable, then the relevant parts will be deemed severed and the remainder will continue in full force and effect.
Entire agreement: these terms together with the documents referred to in them constitute the entire agreement between you, the seller and us and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between us (whether written or oral) relating to its subject matter. Each of us agrees that none of us will have any: (i) remedies in respect of any statement, representation or warranty (whether made innocently or negligently) that isn't set out in these terms or in any document referred to in them; or (ii) claim for innocent or negligent misrepresentation based upon any statement in these terms or in any document referred to in them.
Events beyond our control: if we or a seller is prevented or delayed in carrying out any obligation under these terms or your contract due to 'events beyond our control' (e.g. without limitation, government actions, war or national emergency, terrorist attack, threat of terrorist attack, riot, civil commotion, fire, explosion, acts of God, flood, inclement weather, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to the seller's workforce), failure of public or private telecommunications networks, or restraints or delays affecting carriers or an inability or delay in obtaining supplies of adequate or suitable materials then our or the seller's performance will be postponed for the period of time that the events continue.
Third Party Rights: nothing in these terms or your contract will be enforceable by a third party (e.g. anyone other than us, a seller or you) under the Contracts (Rights of Third Parties) Act 1999 or otherwise. Nothing in this paragraph excludes any of our rights when acting as commercial agent of a seller.
Transfer of rights: we may transfer our rights and obligations under these terms and your contract to another organisation (but this won't affect your rights or our obligations). You may only transfer your rights or obligations to another person if we agree in writing.
Law and jurisdiction: as a consumer, the contracts you make when purchasing products through the site will be governed by English Law. You, we and the sellers agree that the courts of England and Wales will have [non-]exclusive jurisdiction. [However, if you're a resident of Northern Ireland you may bring proceedings there, or if you're a resident of Scotland, you may bring proceedings there.]

The Red Direct Returns Policy
Our returns policy varies depending on the type of item you'd like to return.
How do I return a product during the cancellation period?
Just follow these steps:
contact the seller to cancel your order by using the details found on the order confirmation and dispatch emails. to cancel your order. Please include details of your order so that they are able to find it.
- return the item directly to the seller (not us!). If you've received it, wrap it up and send it back. You must send it to the seller's address which can be found on their page on the site (these can also be found on the order confirmation and dispatch emails. Please make sure that you do this within 14 days from the date you let them know you were cancelling your order.
- don't throw away any product (even if it's faulty) without speaking to the seller. They'll let you know what they want to happen to the item and if they're happy for you to do that. Not getting their agreement may affect any refund you might be entitled to.
- take care when returning products. If you return your item, you have a duty to take reasonable care of it. So ensure you don't damage it or its packaging (where it forms part of it, e.g. boxed garments or gifts).
- you're responsible for any reduction in value whilst the product is in your possession (including when it's being transported back to the seller). You're permitted to handle the products as you would in a shop – anything more than this, and you'll be responsible for any reduction in value.
- we recommend using a signed for service when returning items, and make sure you keep your proof of postage. Don't forget how you return the item is your decision, and you'll need to pay the direct costs of doing so.
When will the refund be made?
Any refund will be made to the payment method used to purchase the item no later than:
- 14 calendar days after the date on which the seller receives the item back;
- or if earlier, 14 calendar days after the date on which you provide evidence of having returned the item to the seller.
If no product was supplied, any refund will be made no later than 14 calendar days after you notified the seller of your wish to cancel your contract.
What is refunded if I cancel my order during the cancellation period?
The seller will refund the payments you made for the relevant product to the same payment method you used to pay for it. Note if you requested an enhanced delivery method, the seller is only required to refund what you would have paid for the least expensive common and generally acceptable kind of delivery offered by them.
Can I return all items?
There are some items that we cannot accept returns of, these are:
- Pierced earrings
- Perishable items like hampers, food, drink and flowers
- Sealed items (e.g. due to health protection or hygiene, or items like audio, video or computer software) where the seal is broken.
- Free items
- Creative items specially commissioned by you
- Items made to order items (including furniture, or items which are personalised or customised that make them personal to you)
If you have any doubt about whether a product can be returned, please check with the seller before ordering. Where any of the above items are faulty, damaged or incorrectly made to order, a refund will be given. Other items may be added to this list from time to time. This does not affect your statutory rights in respect of faulty or damaged goods.

The Red Direct General Store Merchant Guidelines
The Red Direct General Store is an online marketplace where independent merchants sell beautiful, individual, handcrafted and vintage items, curated for you by the Red Direct team.

Handmade items are designed and created by the merchants that sell them. Reselling an item you were not involved in creating is not allowed in our handmade category.
Vintage items are a minimum of 20 years old and must not violate our rules for prohibited items.
Craft supplies are materials and tools intended for use in the creation of a new handmade item.
Prohibited items, services, and items that violate our intellectual property policies are not allowed on The Red Direct General Store.
How do I get on the website?
Not just anyone can sell through The Red Direct General Store. You will need to have been invited on board by a member of the Red Direct team. If you haven’t been approached but feel your product is suitable and would meet our standards, you can apply by click Apply to sell link. Please enclose your biography, registered address, manufacturing address and multiple hi-res images of your products – you must also be prepared to post samples if requested.
Merchants on The Red Direct General Store must meet our standards of customer service and must agree to adhere to our Returns Policy.
Certain types of product are not appropriate for The Red Direct General Store. These include:
- Tobacco and other smokeable products
- Drugs, drug paraphernalia and items making medical drug claims
- Live animals
- Items made from certain animals, including, but not limited to, those animals deemed endangered or threatened under the Endangered Species Act.
- Ivory or bones from ivory-producing animals such as elephants.
- Human remains or body parts (including hair and teeth)
- Firearms and/or weapons
- Hazardous materials (flammable, explosive, corrosive, poisonous, etc)
- Recalled items
- Motor vehicles (cars, motorcycles, boats etc)
- Items or listings that promote, support or glorify hatred toward or otherwise demean people based upon: race, ethnicity, religion, gender, gender identity, disability, or sexual orientation; including items or content that promote organizations with such views
- Items or listings that promote or support illegal activity or instruct others to engage in illegal activity
- Items or listings that promote, support or glorify acts of violence or harm towards self or others
The Red Direct General Store team reserves the right to refuse and remove product listings that we feel are not in the spirit of The Red Direct General Store and may terminate the accounts of any merchants whom we deem to have breached any of our policies.
